Terms of Service

Last updated: August 2026

1. About these Terms

These Terms of Service ("Terms") govern access to and use of Hungry Tum Supply, including its website, ordering platform, WhatsApp ordering services and related supply-chain services ("Hungry Tum Supply", the "Platform", "we", "us" or "our").

The Platform is operated by SHINKAI LABS LTD trading as Hungry Tum and Hungry Tum Supply.

Hungry Tum Supply is a business-to-business service only. It is intended for approved franchise partners, licensed brand operators, commercial kitchens and other business customers ("Customer", "you" or "your").

By creating an account, using the Platform, placing an order or authorising somebody to place an order on behalf of your business, you confirm that:

These Terms do not create consumer rights where the Customer is acting in the course of business.

2. What Hungry Tum Supply does

Hungry Tum Supply provides procurement, ordering, payment, supplier-routing, product-management and supply-chain coordination services.

Products made available through the Platform may be sourced, manufactured, stocked, transported or delivered by independent third-party manufacturers, wholesalers, butchers, distributors, logistics providers and other fulfilment partners ("Suppliers").

Hungry Tum Supply does not manufacture the goods offered through the Platform unless expressly stated otherwise.

Depending on the product, geographical location and available supply route, an order may be fulfilled by one or more Suppliers. The Supplier or fulfilment route used for a product may therefore differ between locations or orders.

Hungry Tum Supply may manage the commercial relationship, ordering process, payment flow, customer service and coordination of fulfilment without being the manufacturer or physical distributor of the goods.

Where an order confirmation or invoice expressly identifies another party as the contracting supplier, that party is responsible for the supply of the relevant goods subject to the applicable contractual arrangements.

3. Brand and site-specific product ranges

Products available through Hungry Tum Supply may vary according to:

Customers will normally only be shown products that Hungry Tum Supply has determined are eligible for their registered site and brands.

The absence of a product from one location does not mean that the product is unavailable at other locations. Likewise, products shown to a Customer at one location may not be supplied to another location.

4. Approved products and alternative specifications

Hungry Tum and its associated brands may maintain different approved product specifications in different geographical areas. For example, a proprietary product available in one region may be replaced by a separately approved product elsewhere where the proprietary product does not yet have a viable distribution route. Where this occurs, the product supplied is deemed the approved specification for that site or territory.

Customers operating Hungry Tum-managed or licensed brands must use products designated by Hungry Tum as approved for that brand and location. Customers must not independently substitute branded, proprietary or approved ingredients with alternative products without prior approval from Hungry Tum.

Hungry Tum may amend approved products, recipes, suppliers or specifications where reasonably required because of availability, distribution, product development, food safety, commercial considerations or changes to the brand.

Where any substitute creates a material change to allergens or food preparation requirements, relevant information will be made available to the Customer.

5. Supplier routing

Hungry Tum Supply may route orders through different Suppliers without requiring the Customer to select the underlying Supplier. Routing may take account of matters including:

A product displayed under a single Hungry Tum product name may therefore have more than one approved fulfilment route. An order may also be split across multiple Suppliers and delivered separately.

The Customer acknowledges that one Hungry Tum Supply order does not necessarily mean one physical delivery.

6. Product availability

All products are subject to availability. Displaying a product on the Platform does not guarantee that stock will remain available when the order is processed by the relevant Supplier.

Hungry Tum may:

Where a commercially or operationally suitable fulfilment route cannot be found, Hungry Tum may decline or cancel the affected line.

Hungry Tum does not guarantee continuous availability of any particular Supplier, SKU, brand, product or delivery route.

7. Orders

Orders submitted through the Platform or authorised WhatsApp ordering channel constitute an offer to purchase. An order becomes binding once it has been accepted and payment or other agreed payment authorisation has been confirmed.

The Customer is responsible for checking:

before submitting the order. Hungry Tum is not responsible for costs arising from incorrect information supplied by the Customer.

8. Pricing

Prices displayed through Hungry Tum Supply may vary by product, site, territory or commercial arrangement. Unless expressly stated otherwise, prices are exclusive of VAT.

Prices may change due to Supplier pricing, product availability, market conditions, taxes, transport costs or other supply-chain factors. Price changes will not normally affect a confirmed order unless there has been an obvious pricing, technical or data error.

Hungry Tum may refuse or cancel an order affected by a manifest pricing or system error.

9. Payments

Payments may be processed through Stripe or another approved payment provider. Payment details are processed by the relevant payment provider and Hungry Tum does not ordinarily store complete payment-card credentials.

Unless separate credit terms have been agreed in writing, orders must be paid for before fulfilment.

Customers must not initiate unjustified payment disputes or chargebacks in place of following the claims procedure set out in these Terms.

Hungry Tum may suspend accounts where there are outstanding payments, abusive chargebacks, suspected fraud or other material payment disputes.

10. Cancellation and non-refundable orders

Because Hungry Tum Supply places orders with external Suppliers and Suppliers may allocate, manufacture, pick, prepare or dispatch goods specifically in reliance on an order, orders are non-cancellable once Supplier commitment or fulfilment has begun.

Payments for properly accepted and fulfilled B2B orders are non-refundable. A Customer changing its mind, ordering an incorrect product or quantity, failing to use stock or being unable to sell the stock does not create a right to a refund.

Where an accepted claim relates to a shortage, damaged product or failed fulfilment, Hungry Tum may, depending on the circumstances, replace the affected goods, arrange Supplier redelivery, issue an account credit or provide another reasonable remedy.

Cash refunds are not the standard remedy and will only be issued where Hungry Tum considers them appropriate or where required by applicable law. Nothing in these Terms excludes rights that cannot lawfully be excluded.

11. Perishable, chilled and frozen products

Customers acknowledge that foodservice products may include chilled, frozen, fresh and other perishable goods. The Customer is responsible for ensuring that:

Hungry Tum is not responsible for deterioration occurring after delivery because of incorrect handling, delayed unpacking, unsuitable refrigeration/freezing or other Customer-controlled circumstances.

12. Delivery

Delivery dates and times are estimates unless Hungry Tum expressly agrees a guaranteed delivery service in writing. Deliveries may be performed by Suppliers or independent logistics providers.

Hungry Tum will take reasonable steps to coordinate fulfilment but does not guarantee that third-party delivery networks will operate without delay or disruption.

Events such as:

may affect fulfilment. A delayed delivery does not automatically entitle the Customer to compensation or cancellation.

Where the Customer causes a failed delivery because the premises are closed, inaccessible, incorrectly addressed or unable to receive the goods, additional delivery and re-delivery charges may be payable.

13. Inspection and supply claims

Customers must inspect deliveries promptly. Visible shortages, incorrect products or damaged chilled/frozen goods should be reported as soon as reasonably practicable on the day of delivery. Other delivery discrepancies should normally be reported within 24 hours.

A claim should include, where applicable:

Affected goods should not be disposed of until Hungry Tum or the relevant Supplier has confirmed that disposal is permitted, unless retention would create a food-safety risk.

Failure to provide reasonable evidence may prevent Hungry Tum or the Supplier from validating a claim.

Hungry Tum may submit and administer claims with Suppliers or logistics partners on the Customer's behalf but cannot guarantee that an independent Supplier or carrier will accept a claim.

14. Product quality and third-party Suppliers

Independent Suppliers are responsible for manufacturing, packing, handling and/or physically supplying goods in accordance with applicable food-safety and product laws.

Hungry Tum may approve products and Suppliers for use within its network but such approval does not make Hungry Tum the manufacturer of those goods.

Customers must inspect product labels, ingredients, allergen information, use-by/best-before dates and storage requirements supplied with the physical product.

Where information appearing on a physical product differs from information displayed digitally, the current legally required information supplied with the physical product should be checked before use, and the Customer should contact Hungry Tum where clarification is required.

15. Allergens and food safety

Customers remain responsible for food preparation and food safety within their premises. This includes ensuring that staff:

Hungry Tum must be notified promptly if the Customer becomes aware of any safety concern, product recall or suspected product contamination.

16. WhatsApp ordering

17. Service communications

Hungry Tum may use email, telephone, SMS, WhatsApp or Platform notifications to provide communications reasonably necessary to operate the Customer's account or fulfil orders.

These may include:

These messages are service communications rather than marketing communications where their primary purpose is necessary account, order, brand or operational information.

Customers should ensure that Hungry Tum has up-to-date contact details for relevant operational contacts.

18. Marketing communications

Hungry Tum may send Customers information relating to Hungry Tum Supply, participating brands, new products, supply availability, reorder reminders, product launches and other relevant B2B services where permitted by applicable law.

Marketing preferences will be respected. Customers may opt out of marketing communications at any time using the unsubscribe method contained in the communication or by contacting admin@hungrytum.co.

Opting out of marketing does not prevent Hungry Tum from sending operational communications necessary for account administration, fulfilment, safety, contractual matters or active brand operations.

Where applicable law requires consent for a particular type of electronic marketing, Hungry Tum will obtain that consent separately.

Acceptance of these Terms is not itself treated as consent to electronic marketing where separate consent is legally required.

19. Customer communications and preferences

Customers may be asked to specify preferred communication channels. Where a Customer objects to direct marketing, Hungry Tum will maintain appropriate suppression records to help prevent further marketing to that contact.

Customers are responsible for notifying Hungry Tum if contacts leave the business or should no longer have access to the Customer's account.

20. Personal data

Hungry Tum processes personal information in connection with operation of the Platform. Information may include:

Hungry Tum may process this information for purposes including:

Depending on the processing activity, Hungry Tum may rely on contractual necessity, legal obligations, legitimate interests or consent.

21. Sharing data with service providers

Where reasonably required to operate Hungry Tum Supply, information may be shared with organisations including:

Information will only be shared where reasonably necessary and subject to applicable data-protection requirements.

A separate Privacy Notice describes this processing in greater detail.

22. Customer account responsibilities

Customers are responsible for:

Activity performed through an authorised Customer account may be treated as activity authorised by that Customer unless the Customer has previously notified Hungry Tum of compromise.

23. Brand intellectual property

All trademarks, brand names, recipes, build specifications, product specifications, photographs, menu information, training materials, software, designs and other intellectual property provided through Hungry Tum remain the property of Hungry Tum, the applicable brand owner or its licensors. Access is provided solely for authorised operation of the relevant business or licensed brand.

Customers must not:

24. Platform availability

Hungry Tum aims to keep its systems available but does not guarantee continuous or uninterrupted access.

Access may be affected by:

Hungry Tum may change, suspend or withdraw features where reasonably necessary.

25. Suspension and termination

Hungry Tum may suspend or restrict a Customer's account where reasonably necessary because of:

Suspension does not remove the Customer's obligation to pay amounts already due.

26. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded.

Subject to the above, Hungry Tum will not be liable for indirect or consequential loss, including:

arising from use of the Platform, Supplier failure or fulfilment disruption.

Hungry Tum is not responsible for acts or omissions of independent Suppliers or logistics providers except to the extent that Hungry Tum itself has breached an obligation owed to the Customer.

For claims arising directly from a particular order, Hungry Tum's aggregate liability shall, to the fullest extent legally permitted, be limited to the amount paid by the Customer in respect of the affected order.

For other claims under these Terms, Hungry Tum's total aggregate liability in any 12-month period shall be limited to the amount paid by that Customer through Hungry Tum Supply during the preceding 12 months.

27. Customer indemnity

To the extent permitted by law, the Customer will be responsible for loss or claims resulting from its:

28. Events outside our reasonable control

Neither Hungry Tum nor the Customer will be responsible for delay or failure caused by an event outside that party's reasonable control. This may include natural disasters, severe weather, war, civil disturbance, industrial action, transport disruption, cyber incidents, power or telecommunications outages, government restrictions, epidemics, Supplier failure or other supply-chain disruption.

This does not affect obligations already due, including payment obligations.

29. Changes to these Terms

Hungry Tum may update these Terms to reflect:

Material changes will be communicated through the Platform, email or another appropriate channel. Continued use after the effective date of revised Terms constitutes acceptance of those Terms where legally permitted.

30. Entire agreement

These Terms, together with any applicable commercial agreement, franchise agreement, brand licence, order confirmation and policies expressly incorporated into them, constitute the agreement governing use of Hungry Tum Supply. If there is a conflict between these Terms and a separately signed commercial agreement, the separately signed agreement will take precedence to the extent of the conflict.

31. No waiver

A failure by Hungry Tum to enforce a right immediately does not waive that right.

32. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in force.

33. Assignment and subcontracting

Hungry Tum may use Suppliers, subcontractors and service providers to perform parts of the service.

The Customer may not transfer its rights or obligations under these Terms without Hungry Tum's prior written agreement.

34. Governing law

These Terms and any dispute or claim arising from them are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction.
